I was going through my divorce. A friend of mine recommended her. I went to her office for our first appointment and she explained everything to me, including all fees, which most attorneys don’t tell you. She did the divorce as it was asked...

Child Support Calculation

Child Support is calculated using both parties' respective incomes pursuant to Florida Statutes. Additionally, any amounts paid for childcare and/or health, dental and vision insurance are also considered for child support calculation, as well as the time each parent spends with the child(ren).

Time-sharing

Time-sharing refers to the time each parent spends with the minor child(ren). Parents can decide what schedule is right for their respective family.  One of the most common time-sharing plans is one in which one parent spends the majority of the time with the kids, and the other parent has overnight time-sharing with the children on alternating weekends from Friday through Monday, pick-up and drop-off at school with one additional weekday overnight every week.  Another popular time-sharing agreement is the 50/50 arrangement whereby each parent spends equal time with the children.  This type of arrangement works best when the parents live within close proximity of each other and have good communication. A 50/50 plan may consist of many variations. For example, 50/50 could be one week with one parent another week with the other. It could also be alternating weekends from Friday through Monday,  with two weekday overnights every week as opposed to one. With all time-sharing agreements, holidays are usually alternated or shared.

Parental Responsibility

The Florida legislature has long eliminated the words "custody, custodial, or non-custodial parent and visitation from Florida family law statutes, as it found that such words included certain possessive connotations to describe the relationship between parent and child. Parental Responsibility is the term used now by Florida courts to address the rights and obligations of each parent as it related of the minor children.  Shared parental responsibility means a court-ordered relationship in which both parents retain full parental rights and responsibilities with respect to their child and in which both parents confer with each other so that major decisions affecting the welfare of the child will be determined jointly. Sole parental responsibility means a court-ordered relationship in which one parent makes decisions regarding the minor child.  In Florida, the majority of parents have Shared Parental Responsibility. This term will also be addressed in your Marital Settlement Agreement/Parenting Plan.
